Platform Terms: Payments & Communications

These terms govern how payments and communications work on OnIslandAgent.com. They apply to property owners who subscribe to the service and to independent on-island contacts in the agent network. Both parties transact and communicate exclusively through the platform.

1Core operating principles

Merchant of record and payment exclusivity. OnIslandAgent.com is the exclusive billing entity and payment collection agent. Property owners pay OnIslandAgent.com directly by subscription. Under no circumstances may an owner pay an on-island contact directly, and no on-island contact may solicit off-platform payment.
Centralized telephony and communication protocol. All call routing, notifications, and emergency dispatches flow exclusively through the platform’s provisioned telephony and SMS infrastructure. Direct off-platform communication outside of an active, county-authorized emergency is a violation of platform rules.
Anti-circumvention and platform integrity. Bypassing the platform to form private, direct side agreements voids compliance representations and results in immediate account termination for both parties.
AI screening ahead of live agents. Inbound calls are first handled by an automated screening layer that identifies the caller, the property, and the nature of the request before a live, on-island agent is engaged. This layer keeps the owner’s subscription cost low — owners don’t pay live agents to field after-hours, routine, or irrelevant calls — while genuine emergencies still reach a live human. The service is backed by live on-island agents after screening, and callers are told so if they ask.

2Exclusive payment processing

All subscription fees, retainers, and platform service charges must be processed exclusively through OnIslandAgent.com. Property owners shall not offer, make, or arrange any direct payments, cash transfers, or side compensation to independent on-island contacts. Any attempt to transact off-platform constitutes a material breach of these Terms and will result in immediate termination of the contact designation and forfeiture of prepaid fees.

3Communication conduit & non-circumvention

OnIslandAgent.com provides the automated telephony infrastructure through which all emergency and routine communications are routed. Independent contacts and property owners agree to maintain all administrative and operational relationships within the platform infrastructure. Independent contacts are independent contractors acting via the platform and are prohibited from soliciting off-platform representation agreements with introduced owners.

4On-island contact payment & non-circumvention obligation

As an independent contractor on the network, you receive fixed monthly retainers exclusively disbursed via OnIslandAgent.com. You agree never to solicit or accept direct cash, checks, or third-party digital payments from property owners introduced through the network. Bypassing the platform results in immediate deactivation, revocation of all assigned properties, and forfeiture of accrued retainers.

5Checkout acknowledgment

Before completing a subscription purchase, property owners confirm the following acknowledgment at checkout:

“I understand that all billing is handled exclusively through OnIslandAgent.com. I agree not to negotiate or pay direct fees to the assigned local contact outside of this platform.”

Billing appears on card statements as Maui Tom’s Inc., the parent company of OnIslandAgent.com.
